Should I Be Worried?

Just got an email from Adsimilis that has me worried a bit:

Just a friendly reminder to please make sure that you own the rights to the images you are using for our dating campaigns. If you need suggestions of appropriate places to purchase images, please ask your affiliate manager.

Is this just a "we have to say it" kind of thing or whatever, what I was thinking earlier doesn't come to mind but I'm sure you know what I mean.

I use images I find all over the place and usually edit them in Photoshop, cropping, adjusting levels, etc.

Is this a big no with Adsimilis? I find that hard to believe and I'm guessing this is just some required shit they have to do, some yellow tape or however the saying goes.

Or, is this real and has anyone ever had problems using their images with Adsimilis?

I'm sure this isn't the case but I'd still like some reassurance so Adsimilis doesn't turn around one day and say "Aha! So much for your 5 grand! You didn't own the image you were using!".

I don't know Admilis but the I've never been bagged on about images from a network.

Only 1 time from POF ben, i was apparently using a copywrite image


Did they threaten to not pay?

got the same email :-) don't worry. in the end you are the one that "could" get a cease and desist..oh no im scared :-) . if i were you i would reach out to your am and ask what's the reason for that email. if you use amateur pics i highly doubt that you will ever get problems...using celebs is another thing..reach out to your am and ask what's up. they can give you a qualified answer.

I cant even get these guys to let me into the network. Went on skype with to mangers.

Oh well plenty of others i already had and new ones were happy to get the traffic!

adsimilis is great and they do care about their affiliates...just reach out to your am and your concerns will be solved asap. no need to worry too much here. basically the email says that you shouldn't use copyrighted images or images that could hurt the brand..which is a no brainer. so it's all good bro ;-)

Ok thanks for the info man, and yeah I'm just using amateur pics so yeah I highly doubt I'll ever have any problems I just thought I'd check.

So in other words you don't need to "own" the images, just don't use copyrighted or potentially problematic images. Adsimilis basically operates like any other network, it just so happens to send these mass emails out. Sounds just about right.

So yeah that clears everything up thanks guys.

i'd say their legal probably just had them blanket mail it so that if in the event that the network ever got a legal complaint re:copyright, they would be able to pass it on to you to indemnify them (which they already can do, this just makes it crystal clear). That being said, like other people mentioned, don't use celeb imgs etc and you'll most likely be fine. I'd be willing to bet that 99% of dating affs don't own the rights to their images. Just be sure not to use soldiers, celebs, etc and you'll probly be ok. Also consider setting up an LLC, and not maintaining too much money in it just in the event of a worst case scenario. (not expert legal advice, there is more to it than this, just some general thoughts)

exactly..and in my opinion it's a good thing that they warn affiliates to prevent them of getting into trouble. and they have to make sure that they are not damaging the advertisers brand..which could happen if affiliaites take it too far. so the best advice is, simply reach out to your AM (they don't bite...most of the time :-)) and clear things up. if you are running dating you're in good hands with adsimilis.

btw, how can i prove that i own the rights to the image?

suppose i took a pic of a random girl passing by and she said that i could use her pic for online advertising...and i don't have her contact info...

so...as long as the actual person in the picture doesn't complain about the image, we are good, right?

coz if it comes to "proving" that we own the rights, i don't know how that is possible unless i buy stock images :/

if someone gave you the rights to use their image, then who would be pressing charges against you? Copyright is not a criminal statute that I'm aware of so the state / government isn't going to be randomly prosecuting you for it. The person who owns the rights to the image has to file a claim, usually they issue a C&D or DMCA takedown. So if someone gave you the right to use it, who is left to file a claim against you?

^^ that is what i am saying...as long as the person in the picture doesn't do anything, we don't have to "prove" to anyone that we own the rights...

What kind of annoying AM would send that one? Oh wait... I did.

Here's the scoop, I sent that mass email to everyone who runs dating with us because we've had an increasing number of advertisers complain of getting slapped with C&Ds for use of images without the owner's permission. *For the record, I classify 2+ in a week as increasing.

We always fight for our affiliates, but when we get asked to pause an image because of a C&D complaint, we kindly ask affiliates to pause the use of the image. Seems fair to me!

Ever lose a 6-figure/month advertiser over using an unapproved image? I have! That's why us networks are such sticklers. So to the previous comments re:celebs and dead soldiers... http://i.imgur.com/ifmqr.gif

And be careful, some advertisers are SUPER strict on this. For example, if you're running the "People Meet" offer with any network and you're using images you don't own, consider this your heads up that if they see the ad, you'll definitely get kicked from all of their offers. Sounds strict, but as a Match.com company, they can be! Hello brand equity and unnecessary lawsuit settlements!

Looking for images you can own all by your lonesome? Try shutterstock for $3 or extralunchmoney.com (Look ma, Fiverr 4 pr0n! 5 points if you find an AM...). My reward to you for making it to the end of this post. Oh, and grassr00ts - DM me!

which name and/or email did you sign up with? I send follow ups to each publisher who signs up, and if it went to spam, chances are you didn't get it.

Good guy Adsimilis is just looking out for you guys. As previously mentioned, POF did get handed a lawsuit and now we AND the affiliate have to shell out 5 figures to fight it. So your worries about not getting paid are small potatoes when you think about the greater consequences. It is rare that it gets to this stage (most people will just email me and I'll email the affiliate to shut down the ads) but some people do take it to the legal level.

Thinkstock.com is a good site to get royalty free images, it's an aggregate of a bunch of stock sites all in 1. And there ARE amateur looking photos there, they're just harder to find than usual.

Good stock photo outlets there. Use thinkstock alot actually. Amateur pics aren't that hard to find.
