So, i got about 5000 mobile numbers stored now, all agreed to a privacy policy wich plainly stated that they will be sent commercial sms messages. They agreed to it by checking a box that they agree to the privacy policy.
Am i safe to message now? Some people tell me i am, others tell me i most defenatily am not, and am risking FBI investigation when i do....
Any input from someone who actually does this would be appreciated. My privacy policy is ironclad, written by snapterms.
If I were you I would talk to one of the people doing compliancy at any network that deal with shortcodes. E.g Gametheory or Mundo.
Yeah talk to someone who's in the know. If people agreed to your privacy policy you should be fine provided all SMS have the opt out/cancel message they all need to have and you message them as frequently as suggested in the policy.

I would have a lawyer who is familiar with IM review my privacy policy. $300 bucks for an hour of a lawyers time is cheap in comparison to a lawsuit. That's just me though.
There are legal restrictions in place, but I know they are not really pursuing people right now. Leave a pretty open "gap" for money to be made.
