SilverPath & GameTheory Scary Emails

I received an email from both Silverpath and GameTheory saying mobile auditors have stepped up their game in search for non-compliant pubs and each network has the right to not only withhold payouts, they also can make you pay any fines associated with your lander... which GameTheory said could be as much as "Millions".

Everyone get these emails today? Concerns?

In addition to our continuing efforts to meet or exceed mobile consumer best practices, we have observed that the Carrier auditors have also stepped up their efforts to closely monitor industry advertising practices.

With the increasing vigilance, we want to remind you of your continuing obligation to ensure that all the advertising promoted by you and any sub-affiliates is 100% compliant. Examples of non-compliant marketing include, but are not limited to, spamming Facebook/Craigslist, advertising on content locking sites such as those offering “free movies”, working with any of our blacklisted partners, iframing our offer in any way that obscures the pricing, terms, or other pertinent offer details and creating landing pages that entice users with false claims and/or deceptive advertising. We encourage you to review all the Terms & Conditions you agreed to in our IO, which can be found at http://www.gametheory.com/terms_conditions.php.

As you already know, we have the right to withhold payment to you for leads generated through non-compliant sources. Even further, we can demand from you any damages for the losses we incur if the Carrier imposes monetary sanctions against us. Given that much of our mobile leads are on shared shortcodes across all of our traffic, this can be very substantial (millions). While this may come off as stern, we want to make it very clear that we take these matters seriously, as do our competitors, who have equally as stringent views on these matters of compliance.

We ask that you make every possible effort to only run compliant advertising and take responsibility for anyone driving traffic on your behalf. If you have any questions concerning compliance or would like to get approval on a specific traffic source, please do not hesitate to contact Justin Gorrell at Justin.Gorrell@gametheory.com.

We are in this for the long term, and to do so, we have to continue valuing our relationship with the Mobile Carriers. If we all work together to meet or exceed consumer best practices we can continue to grow and be successful in the mobile marketplace.

Please note that we not only have the right to withhold payment to you for non-compliant leads, but we can demand from you any damages we sustain from the losses incurred should a Carrier impose monetary or other sanctions against us. For example, if you are identified as an Affiliate who is running non-compliant advertising that results in the loss of one or more short codes, you will be held responsible for that loss, which could, in a worst case scenario, amount to several million dollars.

We ask that you make every possible effort to only run compliant advertising. Should you have any questions at all concerning compliance, please do not hesitate to contact your affiliate manager.

By working together, we can meet and exceed the Consumer Best Practices that have been prescribed for our industry. By providing quality services and by actively communicating with each other to ensure 100% compliance, we can all continue to grow and be successful in the mobile marketplace.

Yes everyone got them and I'd take those emails seriously because GT and SP take their business seriously as well. Don't run any disapproved / not approved stuff and you'll be fine.

Ya I smell some shit about to go down.

I'm going to email my landers to my reps, so at least I have proof that they said mine were compliant. Based on the fact they should know, since they are working close with Carrier auditors.

yeah i may pause all my stuff just to be safe. In the past, networks have sent emails like that AFTER they have been contacted about pending problems/lawsuits/fines etc. They encourage sending the volume and could care less about compliance in the beginning and then when the shit hits the fan they start with the "We have always stood at the forefront of compliance and consumer protection and lead the industry in being guardians for our advertisers... blah blah" emails

oh well.

lets just say...we all know what we are doing.....and there are def some of us pushing it....I would ask kindly that the few that are doing that....please don't ruin it for the rest of us....and if that's not motivation enough for you...not getting paid....hopefully is.....

glad I've emailed all my landers to my reps getting approvals and adding/changing anything that needed to be done.

Yep MAKE SURE you send your rep your lander and get a response from him that says:

"Hey Gary,

You're good to go :-)"

Whew, now I can sleep better at night!

I'm having trouble getting through to my AM, can someone please clarify what is OK to have on a co-reg lander, which is using an email submit at the end? I'd really appreciate your help.

I've cloned graphics from the email submit and it has the word "free" on there, do i need to have text at the bottom saying participation required? (If i'm not allowed to have text saying Free can i have it in the audio?)

I've created a very sexy iframed page (good graphics and jQuery animations) and i am laying it out like this is the third stage of getting the gift card, so "stage 1 enter details", "stage 2 confirm pin", "stage 3 get giftcard" - is this allowed? I'm suggesting that i need their pin confirmed to get the prize but in reality we don't...

Maybe i'm overthinking this but i want to get it all 100% legit as i hope you can all relate to

Also... the main guessology "confirm your cell number" mobile offer is not pre-popping (i have the correct path variables so that isn't it), is this often the case?

1) no usage of "FREE" anywhere (including audios).
2) the wording in stage 3 is misleading, you should say "Step 3: have a chance to win your gift card".
3) no idea, ask your AM

I just send my LP's to my AM. They were all approved by AIM, but it's not bad idea to have them in mail also

thanks guys, really appreciate your input! As for the pre-popping not working i think it's just because i'm from the UK and was using random numbers!

My AM from SP just ok'd the use of the word Free aslong as you have "Participation required" nearby! handy to know!
