Using custom creatives on network that doesn't allow custom creatives?
Is there a high risk with using custom creatives with a network that doesn't allow custom creatives?
How can they find out exactly which creatives you were using?

It's all in the refferer path, they can see where the click came from and eventually find out what the creative was.
They also do their own screening with some bots and then people can report you.
How much of a risk it is depends on the offer and advertiser. For example with carrier billing offers, the rules can be pretty strict and people complain a lot. With simple lead gen offers, the complaints are not so frequent.
One way or another, its a breach of contract and they can refuse to pay you.

One Weird Trick on this that's always worth trying: ask.
Some of the time, a network will have "No Custom Creatives" listed because they don't want some random noob running something totally insane. If you're known to the network and your AM, you've run a bit of volume, and you have a rep for not being a complete idiot - or sometimes even if you aren't, but you just have the smarts to ask nicely - they'll sometimes say "yeah, sure, run custom, but pass it by us first" or similar.
If you don't ask you don't get.

I recommend you ask. You dont want to wake up one morning and see that the advertiser deceided not to pay because you used unauthorized creatives and got busted.
If you dont like this "rule" than either ask your AM if there is a chance to make an exception or just run a different offer(s).
