Hey guys,
we capture (not only) the email adress on our landing pages and want to email them other relevant offers etc.
Since I'm from Germany I'm not really familiar with the legal aspects regarding email marketing.
Is it ok to email them without accepting our newsletter through a check box or something like that (single opt in)?
Or do they definitely need to confirm their email adress after opting in?
Would it be enough to use a check box that says something like "Receive financial tips via email" on the landing page?
Appreciate your help!
Thanks!
Valentin
Given the truly draconian penalties for CAN/SPAM Act violation (US$16,000 per noncompliant email message), you probably should make sure you fully understand the law before emailing anything to US consumers. https://www.fcc.gov/consumers/guides...ages-and-email
Data protection laws are different from country to country. Some are tougher than others. Best is to check with your legal counsel once you start doing big volumes and come on the regulator's radar.
Eg netherlands is very strict. Run this article through google translate. I don't know if daisycon eventually got the fine or they managed to dodge the bullet in court, but according to the article the regulator gave them an 810K fine for violating data protection laws.

Follow CAN-SPAM 100% of the time!
How do you do that? Let them confirm their email after the form submit?
CAN-SPAM is only for the US, no need to follow it if you are doing data collection outside the US. Again, its regulated on a country per country basis.
I see you're from Germany - you will need to follow the German data protection laws.
Hey guys,
I'm sending emails to US subscribers and sure, I follow the CAN SPAM Act guidelines (out out link, postal adress etc).
Do they even need to confirm (double opt in) their email adress if I use the following disclaimer right before the form submit button?
"We take your privacy seriously. By clicking “Get My Quotes” you agree to share your information with up to 5 participating lenders,
which may include the lenders, their brokers and partners and for them to contact you about mortgage/refinance offers (including through automated means
e.g. autodialing, text and pre-recorded messaging) via telephone, mobile device (including SMS and MMS) and/or email, even if your telephone number is currently
listed on any state, federal or corporate Do Not Call list. Consent is not required as a condition to purchase a good/service. By submitting my information, I confirm
that I understand and agree to the applicable Privacy Policy and Terms of Service."
Thanks guys for your help!
