About the image copyrights (gaming vertical)
Hi guys!
I'm promoting games in Facebook and in some cases, I use images/screenshots (or parts of images) from another games (not the promoted one). Should I be worry about this? It's something that can create me legal problems with the copyright?.
I have seen some threads here talking about ad creation with great CTR and they use celebrities images and stuff like this, I really don't know where is the limite, what images you can use and what not, of if for example you can't use a full image with copyright but you can use some parts of the image.
Anyone can help me? Anyone have had a bad expierence or a legal problem about using copyrighted images?

Of course it can cause legal problems. If caught you'll probably get a notice telling you to stop using the image or face legal actions and that's it, but in other cases you may get a more aggressive notice asking for $ or face legal action and they can ask for a lot of $.

Using company A's intellectual property to promote company B, doesn't sound that great if you think about it.

We have a gaming company using our reverse image analysis tool to check for infringement like this. Don't do it. There are better ways!

The ones who are doing this are the ones betting that they will not get caught. From a legal perspective, these people are definitely on the wrong side, whether using fake endorsement, images of celebrities without their permission, logos of other companies or copyrighted images.
FTC website has plenty of cases and judgements, for example:

I'd suggest you stay away.

Don't use one company's product images to promote a competitor unless you're VERY sure you know what you're doing.
In the realms of "things that are likely to get you a Cease And Desist at the very least", that's pretty high up there.
(Theoretically there MIGHT be a parody or quotation defense, in some parts of the world, if you were very sure about what you were doing, had specifically designed your angle and ads for this, had consulted a lawyer, and were prepared to go to court if necessary. The chances are extremely high that this does not apply to anyone reading this.)

But... and what about this kind of creativities:

I mean taking some celebrity picture and make a creative with this (I see a lot of post with an angle based on Justin Bieber, LOL). It's true that all this posts are old and perhaps it is a practice you can use some years ago but not now.
And to take a random picture from google images (not a game) or from deviantart, what about this? if it's not allowed the creativity work turn really hard to do.

99% of the cases it wont be a problem but you know you are using someone else's intellectual property without their approval = not allowed and can get you into trouble, but the internet is still the wild wild west so most probably nothing will happen. If you wanna be 100% sure youre on the safe side, develop your own materials or buy the intellectual property on the creatives youre using with gettyimages or so....it all depends on your risk profile

There are three different questions.
1. What is legal?
2. What do you think you get "get by" or "get away" with doing?
3. What you feel comfortable doing?
As for 1, it is pretty clear what the answer is.
As for 2 and 3, well, no one can speak to those except you.

Probably I'm not comfortable taking a picture for some big game company and using it to promote another one, it is obviously a not recommended thing to do and probably for this reason I opened the post, but with another images I don't know the answer and I'm pretty sure that 90% of affiliates use this resources (google images, deviantart,...) I supposed than the weaker the copyright owner is, the less probably is for you to get in trouble using the copyrighted work.
