Network Not Paying. What Can I Do?

Before I begin, I want to confess I made a big mistake by working with a network no one in my circles had ever heard of. Lesson learned...

I met a small PPCall/CPA network @ ASE. They had an offer for a b2b service that I was already creating calls for, so I decided to give them a try. I sent them about $600 in leads and then asked them to double check lead quality before I continue sending traffic. They said the client liked the quality and to send more. Over the next two weeks I sent them $2-3k more in leads. The offer then paused and they didn't know why. I sent them an invoice at the end of the month and didn't think anything of it.

Net 30 went by and I hadn't received payment. I gave it another week and then I started chatting with the network owner on Skype. His reasoning for the late payment changed every-time we chatted. First he said all payments were behind, then he said he was just waiting for the clients "reject" list, then it changed to they can't payout until they get paid by the client. He got progressively harder to get a hold of and shadier as time went on. After the payment was over a month late and I hadn't heard from him for two weeks he finally responded saying the client doesn't want to pay for the leads, therefore his network will not pay me. He had no other details from the client and said there was nothing he could (or would) do about it. I pleaded with him to confront the client about not paying and find out their reasoning. I gave him all my campaign creatives and all the recordings of my leads to share with the client. The next day I noticed all record of my leads had been removed from invoca. Now a week has gone by and he has disappeared again, I can't get hold of him…

Do I have to write this off as an expensive lesson or is there action I can take to get my money?

Well, there is not much you can do.

Legal actions for 3k? Forget it...

There is only one option: to play the reputation game with them.

First of all you should tell him that you've started a thread about them not mentioning their business name on the forums (not joking).

List the forums that you are a respectable member of, give some specific data like how many members it has.

Find out where they are from and mention also the most famous affiliate forums from that region that you have a friend that is an admin/moderator there.

Say to him, that if he won't pay you in the next 7 days. You will tell every one of affiliate buddies that you know personally and on the forums that they are scammers.

Reputation is everything for an affiliate network and everybody there is taking it very seriously (worked at one for a 1,5 years).

I don't think they are total braindeads if they were at ASE.

Out them after a certain deadline both here and on public forums like WickedFire etc.

The key is for it to show up in Google.

Looks like incorporated in VA, USA

Well you can definitely sue the company. This doesn't mean you will be able to necessarily collect even if you win, but at least it will give you a better legal standing to try to enforce any judgement.

Call them out anywhere you can. Facebook affiliate groups, here, wickedfire, warriorforum, BHW etc. Anywhere! Call the owner out by name and any info you have regarding the company. If nothing else you're at least helping other affiliates not get scammed by these people.
