Against state law to hire someone for commission only. You're setting yourself up to be sued. You'll owe all back pay and if the person is smart they'll sue you and it's going to cost you a bundle. Make sure you pay them minimum wage at least.

If I understand correctly, the OP is offering an unpaid, commission only job in California, and furthermore, as part of the interview process, is requiring each applicant to spend $500 of his or her own money on running a campaign.
If my understanding is correct, this seems very fishy. At the very least the OP should adhere to both the law and basic business good practices.
Both California employment law and good business practice demands that employees get paid for their work.
Don't you offer unpaid internships @cmdeal? Or is it more a legitimate partnership with area universities?

My biggest red flag is how someone with that much revenue--and corresponding amount of profit--is unwilling to spend $500 to test a potential applicant. $5000 to test 10 applicants that in turn earn the OPs company 8 figures in revenue seems like a good roi to me.

California leans on the side of the employees. California is a very sue happy place against businesses. I would even be weary of offering an unpaid internship in this state. With unpaid internships there is a lot of ground for suing. The point of the internship is for the intern to learn, and you can't really have them do anything to help with the day to day operations, or they could be categorized as an employee. Taking on employees can actually be a huge risk. You have to do everything right. Anything wrong and you have a lawsuit at your front door. And you will probably have to pay up and settle since most of the attorneys will take the case on contingency and will make you spend, spend, spend on your attorney. And the employee's attorney will even do this if the case is a bullshit meritless case. They will keep it going as long as possible. The sooner you get it over with, the better. You can mark it off as a cost of doing business. Just my 2c.

Guys I'd suggest to stop the hate against the OP. I don't know him nor do I care, but the situation is probably the following:
1) OP has zero experience about legal aspects involved running a business with employees.
2) He didn't do his homework consulting a lawyer before searching for an employee (which means the contract wouldn't be set up by a lawyer neither, as otherwise the lawyer would have informed him about the commission based payment problem).
3) He asks people to run their own money to a campaign as a test. Not really a good start in my opinion.
Does all this make the OP a scam? Certainly not. The only thing proven is that the OP doesn't have any kind of experience in dealing with employees and how to hire somebody on a fair basis.
Give him a chance to recalculate his approach and maybe come up with something that's a) legal b) sounds like a solid setup c) is a fair deal to all ends.
Often enough good people fail because of legal aspects when taking the next step. Still not a reason to start a shitstorm on somebody.
Personal tip to francis: if you run the numbers you do, invest some of your profits into legal experts. It seems you're missing out a bit on that end - a good consulting could also save you serious bucks over the profits you do, just saying.
