Hey guys, I've got a few questions about the well known FTC.
1) I'm located in Germany, if I'm running diet / muscle / skin offers in the US, do I even have to care about the FTC? I surely understand that if I go really badass it may happen that a local agency would track me down. But if I run the regular stuff, like newspaper etc. is there any risk for me?
2) What about advertising diet / muscle / skin as example in UK and CA? No FTC there?
3) Does anyone ever seen a 100% legit advert for that kind of stuff?
1) The FTC is a US entity.
They care about protecting US citizens and residents, not anyone anywhere else.
That being said, if your daughter was ripped off and basically had $20,000 stolen by a guy living in Germany, would just say "screw it, he's in Germany, there's nothing I can do...".
Hell no. Being overseas wouldn't stop you pursuing them. You'd ring up people in Germany and track the basterd down.
The FTC is basically the same. They focus on the US but given enough impetus would go after you no matter where you are physically present. In which case you better hope you left no trail and your government/regulatory bodies decide that for some reason they don't want to cooperate with the FTC.
In short: if you're pissing off the FTC, you're playing to lose. So, to answer your question, you should be fine as long as you're not doing some stuff that really defrauds/misleads consumers on a large scale.
2) Not sure.
3) Sure.
Thanks Zeno
