Advertiser owes me $150K and is not responding

Been running direct with this rebill advertiser for a few weeks now. First few weeks they were good about paying. $10-20k daily wires. They're always quick to respond on Skype and we even chatted over the phone a few times.

Last week they admitted having issues with merchant accounts, but promised to continue paying me if I keep sending traffic. They work with networks and have experience in this industry, so I decided to keep running.

However, they ended up missed a bunch of payments and now owe me $150K.

They started ignoring my calls and respond very infrequently, promising I'll get a wire soon, but I never did.

It's been 7 days since my last payment and I can't get a hold of them. My guess is they're having trouble getting the funds from the merchants.

I've already paused all my traffic. I can understand if they're having merchant account issues, but to completely ignore your biggest affiliate is completely unprofessional.

What's the best way to proceed here?

Get a lawyer. Make sure you have this in writing, screenshots, etc. They might shut down your affiliate account.

Running direct is risky, especially on trials. Never hurts to ask for pre-payment.

Even networks usually do not extend that much credit to an advertiser, unless they have a good, stable working relationship over months or years.

Its really hard to find reliable rebill guy these times, the same with buying fb goodies. I'd say to allways run rebill through network unless you know someone really really trusted.

But in your subject - I'd think over if you have any mutual friends, offer them % if they would help you get payment. Usually it wont be an easy to get your money, you must have something to make an influence on them.
And more abstract you can allways try scary them, you know their details - Mastercard or others would love someone to sue for generating alias MID's and running rebills.

As others said keep as much evidence as possible.

Try using the scare tactics first and if everything else fails just get a lawyer, 150k is a pretty big amount to be ignored.

get lawyer as soon as possible,

offer them 10-20% of money they will be able to get back

I have been in similar situations before and still in process of getting my money..

First, before you take any action, you need to understand the situation clearly and the options you have ahead of you.

Is the situation a result of the advertiser unable to pay or is it a result of the advertiser unwilling to pay?

Depending on the situation, the approach you take will be very different.

The way you deal with a company that is about to go bust and is unable to pay the full amount is very different from the way you deal with a company which is solvent but is just refusing to pay.

If it is the former, no amount of evidence collection is going to help.

Exactly what I was thinking. I already talked to my lawyer about this and it's most likely his merchants are freezing his funds. If I sue and he files for bankruptcy, then it's just a waste of time.

I'm going to keep hitting him up for a few weeks, threaten to badmouth him, and if still no response, get my lawyer to send him a demand letter. Don't think there's much I can do after that. I spoke with Jason A and he said this is quite common with advertisers in this vertical.

Not dwelling on it that much because it's a waste of mental energy focusing on what already happened. Lesson I took is to never float that amount money and demand prepay next time.

Setback are expected on the path to success, and $150K is nothing compared to my long-term goals.

I was super stressed and worried last week, but over it now. Thanks for everyone's responses.

I'll post updates on what happens!

If you have enough roll to continue your business. Play the cards slow, just let them know that you wants to get the money back on a peacefull way. And let them get time to resolve the things on there end. And also let them know that your willing to give a discount to them to help them out.

You know, even do he or them in that company go bankcrupt , They will still be around , maybee start another business. Try to find out the owner or owners of the company..And be nice to them , maybee agree on a payment plan with some discount after all shit is solved. If nothing happens i doubt its hard to find someone to sell the debt to in LA with all your evidences of dealing with them .

Not everyone is bad ...They can be fucked by someone else, Of cos its wrong to not reply to you. But they also can get into mental problems when they see all there business and life going down in the toilet. - .

Maybee it would be good to have a seperate STM section with problems with affilite programs. As a big forum it would be really worth for the affiliate programs to communicate ..with STM if something is wrong.. Not allways the program that are the wrong ..
