Someone stole my VLS and ripped my LP. What can I do?

Hey,

so after investing quite some time/money in a professional looking VLS and LP, I noticed during my competitor spying attempts that somebody just copied my whole Funnel 1:1!

Not only my VLS and LP Design/Copy/Images but even my Autoresponder series. Basically my complete funnel. The VLS is watermarked with my brand but that doesn't seem to bother him that much...

Well I have done my fair share of competitor research, and yes I might have used headlines etc from competitors but never would I just go ahead and steal a complete funnel!

What I wanted to ask you guys if there is anything I can do? Can I ask for a takedown? Who should I contact? The Traffic Source or the Offer/Affiliate Network?

Is there any chance I can take legal action? Or is that just something I need to live with?

Looking forward to your answers.

Thanks

It's one thing if you rip a LP, change a couple (stolen) pictures and then complain if your new version gets ripped by another affiliate, but in your case I think it's definitely justifiable to take legal action.

Unfortunately I have no idea how to handle a situation like this, but I'd probably try contacting the traffic source, network, web host and tell them to send this person a C&D or sth

DMCA against the webhost.

A C&D is the most cost effective solution in your case.

Very cheap to send one and most people will get scared and drop it.

If I file a DMCA, will that involve legel consequences for the Webhost or does he just need to take it down?

He is not using a domain actually but rather just a rackspace CDN URL. So there is no Whois info on any domain or such. Also I dont see any Privacy Policy, Terms of Use etc. How do I know where to send it to?

Also lets assume he takes down the site, what action can I take against him copy pasting my autoresponder series?

Thank you

DMCA is just a request for the web host to take down the content. You will need to prove you own the landing page which may be tricky.

If the person who ripped your lander is in the USA, a DMCA takedown notice is probably the fastest and most effective way to get the landers removed. He may just move them to a new domain and host, though.

Contact Rackspace in this instance. They have a specific department for dealing with takedown notices - http://www.rackspace.com/es/informat...pyrightnotices

OK thanks for the advice, I already scheduled a Takedown btw.

What can I do about the Autoresponder? Should I write directly to Aweber?

From http://www.aweber.com/service-agreement.htm

If they are sending out your email content via Aweber then you might be able to do something about it.

But can you prove that you wrote them?

Not sure that I can. What would be a way to prove that? The only thing I can think off is that Aweber could check who launched the Autoresponder series first? I will talk to them directly and see what they are saying
