Direct buy publisher kept sending 11k in traffic after pause request

now they are trying to bill me for it.. ?

our last exchange was at the end of november when i had requested to pause the tags and my rep confirmed a pause. now i didn't check the reporting afterward because obviously it wasn't a priority. but if i did i would've found that they continued to sent $10,853 of traffic from dec 1 til dec 31. i checked today and the tag is still live and they STILL haven't paused it.

this is a ridiculous situation because it was the rep's mistake but they are trying to make it look like i'm screwing them because i didn't ask them a second time to confirm the pause. well dipshit that's not how it works i request pause you pause in 24 hrs per the insertion order. blah blah more arguing

it's net30 so i have until end of month this month to resolve. in the meantime they still haven't paused the tag.

who is at fault here? should i even bother thinking about paying? i have no moral obligation to do so in this case. not sure about legal.

It is hard to say, as usually there are two sides to every story.

If there is written correspondence you can post along with the original I/O on when and how campaigns can be paused, then it will be easier to determine legal liability.

Not sure about legalities but if you asked them to pause via email or skype then you could definitely point them to those as a proof. No?

Depends. Some I/O have requirement of notice periods, to whom any such request must be made, whether you have obligations to pay afterwards etc.

Pretty much spot on, a lot of IOs have tricky phrases when it comes to overspending. Doublecheck that IO and get on phone with the source to see what's their point.

On a side note, given they sent you 10k of traffic over a whole month, I think it's kinda tough to say you didn't noticed it from a logical point of view. 10k is quite a bunch no matter how much volume you run.

It's not a question of overspending. Overspending happens due to delayed reporting or underestimating a traffic flow. If I read correctly these guys are running his tags over a week later since his pause request.

Personally if I was in the situation, I would not pay for that extra traffic, knowing that they confirmed the pause.

If it was a mistake I understand. Everyone makes mistakes, but who's mistake was it? Obviously they wouldn't expect you to pay 100% for their mistake?

It doesn't seem like they are taking accountability for their mistake, they are simply taking advantage of your weak position...which is paying for anything they send you.
